Rules.
These Official Rules apply to Gift Lists, giveaways and prize promotions offered by Sammi Barber through the website, social media channels, email, video platforms or other participating channels.
Please read these rules carefully before participating. By entering or participating in a Gift List or giveaway, you agree to these Official Rules and any additional instructions provided for the specific promotion.
A little gift, with clear rules.
From time to time, Sammi Barber may offer a Gift List, giveaway, prize promotion or similar opportunity in which eligible participants may have an opportunity to receive a gift.
These Official Rules establish the general terms that apply to such promotions unless different or additional rules are specifically communicated for a particular Gift List or giveaway.
The specific promotional post, announcement, landing page, email or other communication associated with a particular Gift List may include additional information about the gift, entry method, dates, eligibility, selection process or other conditions.
By participating, you confirm that you have read and agree to these Official Rules and any specific rules communicated for the applicable Gift List or giveaway.
If specific promotion rules conflict with these general Official Rules, the specific promotion rules will control to the extent of the conflict.
Who can participate?
Unless the specific promotion states otherwise, a Gift List or giveaway is open only to individuals who meet all eligibility requirements communicated for that promotion.
Participants must provide truthful and accurate information and must satisfy any age, residency, geographic or other eligibility requirements stated for the applicable promotion.
If a minimum age is required for a particular promotion, that requirement will be stated in the promotional information.
Sammi Barber may request reasonable information or documentation necessary to verify eligibility before awarding a gift.
Employees, contractors, representatives or others directly involved in administering a particular promotion may be excluded where applicable.
Where a promotion is limited to a specific geographic area, only participants located within the stated area will be eligible.
Entering should be simple.
The entry method for each Gift List or giveaway will be communicated with the specific promotion.
Depending on the promotion, an entry may involve completing an online form, submitting an email address, following or interacting with a social media account, commenting on a post, responding to a prompt, subscribing to a communication or completing another stated action.
Only entries submitted in the manner and during the period specified for the applicable promotion will be considered.
Unless expressly stated otherwise, no purchase is necessary to participate.
A purchase is not required unless a particular promotion expressly states otherwise and applicable law permits it.
Sammi Barber is not responsible for entries that are lost, late, incomplete, corrupted, misdirected, inaccessible, technically unsuccessful or otherwise not received.
Automated, fraudulent, deceptive or manipulated entries may be disqualified.
Watch the dates.
Each Gift List or giveaway will have an entry period identified in the applicable promotional information.
Entries received after the stated closing date and time may not be accepted.
Sammi Barber may, where reasonably necessary and permitted by applicable law, extend, shorten, suspend or modify an entry period because of technical problems, circumstances beyond reasonable control, fraud, abuse or other circumstances affecting the promotion.
Participants are responsible for checking the applicable Gift List or giveaway announcement for the official entry deadline and any updated instructions.
How a recipient is chosen.
The method used to select a recipient will be identified in the applicable Gift List or giveaway information where necessary.
Depending on the promotion, a recipient may be selected randomly from eligible entries, based on a stated judging process, through another selection method, or in accordance with specific criteria communicated with the promotion.
Only eligible entries received during the applicable entry period will be considered.
If a random selection is used, the selection will be made from eligible entries received by the applicable deadline.
Sammi Barber’s determination regarding the administration of the promotion and selection of a recipient will be final to the extent permitted by applicable law.
Selected? Check your messages.
A selected participant may be contacted using the contact information provided during entry or through the platform associated with the promotion.
The selected participant may be required to respond within the timeframe specified in the notification.
Before receiving a gift, the selected participant may be required to confirm eligibility, provide accurate contact or delivery information, and complete any reasonable documentation required for administration of the promotion.
If a selected participant cannot be contacted, does not respond within the required timeframe, cannot be verified, is determined to be ineligible, declines the gift, or cannot comply with these Official Rules, the gift may be offered to another eligible participant where permitted by applicable law.
Please make sure the contact information you provide is accurate and that you monitor the communication channel used for the promotion.
What the selected recipient receives.
The gift available through a particular Gift List or giveaway will be described in the applicable promotional information.
Unless expressly stated otherwise, gifts are provided as described and are not exchangeable for cash or another item.
Sammi Barber may substitute a gift with another item of reasonably comparable value where the advertised gift becomes unavailable, discontinued, impractical to obtain, or otherwise cannot reasonably be provided, subject to applicable law.
Gifts are provided without any representation that they are suitable for the recipient’s particular needs or circumstances.
Where a third party supplies a gift, that third party may be responsible for its own product terms, warranties, customer service, returns or other obligations.
Pickup or shipping: your choice.
Unless the specific promotion states otherwise, a selected recipient may choose between free local pickup in Toronto, Ontario, Canada and shipping the gift to an eligible destination.
Free pickup is available in Toronto, Ontario, Canada.
Pickup will take place at the location and within the timeframe communicated directly to the selected recipient.
If the selected recipient chooses shipping instead of pickup, all applicable shipping, delivery or transportation costs are the responsibility of the recipient.
The recipient may be required to pay applicable shipping costs before the gift is shipped.
If the recipient does not wish to pay the applicable shipping costs and does not wish to arrange pickup in Toronto, the recipient may decline the gift.
The selected recipient is responsible for providing an accurate delivery address and any other information reasonably necessary for shipment.
Sammi Barber is not responsible for delivery delays, failed delivery attempts, lost shipments, incorrect addresses or carrier delays, except where required by applicable law.
Where applicable, customs charges, duties, taxes, brokerage fees or other destination- specific charges may be the responsibility of the recipient.
Shipping may not be available to every destination. Availability may depend on the size or nature of the gift, carrier restrictions, destination, cost or other practical considerations.
If a recipient fails to arrange pickup, provide required shipping information, pay applicable shipping costs or otherwise accept the gift within the required period, the gift may be forfeited and offered to another eligible participant where permitted.
You can always say no.
A selected participant is not required to accept a gift.
If a selected participant declines the gift, does not respond, cannot meet the applicable eligibility requirements, cannot arrange pickup, does not wish to pay applicable shipping costs, or otherwise cannot accept the gift under the applicable rules, the gift may be offered to another eligible participant where permitted by law.
Once a gift has been accepted and delivered or picked up, the recipient is responsible for the gift and its use, subject to any rights or warranties that may apply under applicable law or the terms of the product provider.
No one is required to accept a Gift List gift. If pickup or shipping doesn’t work for you, you may decline it.
Keep entries honest.
Sammi Barber may disqualify an entry or participant where reasonably necessary because of suspected fraud, cheating, manipulation, abuse or conduct that interferes with the proper administration of a promotion.
Participants must not attempt to obtain an unfair advantage through automated entry systems, bots, scripts, deceptive accounts, false information or other methods intended to manipulate the promotion.
Entries that contain unlawful, threatening, abusive, defamatory, fraudulent or otherwise inappropriate material may be rejected.
A participant may be disqualified if information provided is materially false, misleading or incomplete.
Where applicable, a participant may be limited to one entry or one gift per person, household, account, email address or other unit as stated in the specific promotion.
Participants are responsible for complying with the terms and rules of any third-party platform used in connection with a promotion.
Your information, handled carefully.
Information collected in connection with a Gift List or giveaway will be handled in accordance with the applicable privacy practices and policies governing the promotion.
Personal information may be used for purposes reasonably necessary to administer the promotion, including verifying eligibility, contacting selected participants, arranging pickup or shipping, and fulfilling applicable legal or administrative requirements.
If a third-party platform, form provider, retailer, shipping provider or other service is used in connection with a promotion, that third party may separately collect or process information under its own privacy policy and terms.
Where participation occurs through a third-party social media platform, the promotion is not sponsored, endorsed, administered by or affiliated with that platform unless expressly stated otherwise.
Participants are responsible for reviewing the applicable third-party platform’s terms and privacy policies.
Sometimes things change.
Sammi Barber reserves the right, where permitted by applicable law, to modify, suspend, extend, shorten or cancel a Gift List or giveaway where necessary because of technical problems, fraud, abuse, circumstances beyond reasonable control, unavailable gifts or other circumstances that materially affect the proper operation of the promotion.
If a material change is made, reasonable efforts may be made to communicate the change through the same or a similar channel used to announce the promotion.
No change will affect rights that cannot lawfully be excluded or modified.
A gift is a gift, not a guarantee.
To the fullest extent permitted by applicable law, Sammi Barber is not responsible for technical failures, communications failures, internet interruptions, platform outages, entry errors, lost entries or other events beyond reasonable control that affect a promotion.
Sammi Barber is not responsible for losses, delays, damage or other issues arising from shipping, delivery, carrier services or third-party providers, except where required by applicable law.
Where a third party manufactures, supplies or distributes a gift, that third party may be responsible for applicable product warranties or other obligations.
Nothing in these Official Rules excludes, restricts or limits liability to the extent that doing so would be unlawful under applicable law.
The fine print, kept simple.
These Official Rules should be read together with any specific instructions, eligibility requirements or additional rules communicated for the applicable Gift List or giveaway.
If any provision of these Official Rules is determined to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
Failure to enforce a provision of these Official Rules does not constitute a waiver of that provision.
These Official Rules are intended to be interpreted consistently with applicable Canadian and Ontario laws and regulations, including any mandatory consumer-protection or promotional requirements that apply.
Where a particular promotion is subject to additional legal requirements, those requirements will apply to the extent required by law.
